Become our client

Once you and the other party have chosen mediation, the formal process begins with signing an Agreement to Mediate. WeMediate will facilitate this step, coordinating with both parties to ensure it is executed correctly. This agreement is the foundation of a process conducted in line with the principles of the Gauteng Mediation Protocol, emphasising confidentiality and good faith.

If you have already initiated court proceedings, you can still choose mediation. Simply notify the clerk of the court of your intention to mediate. It can be done at any point before judgment, though acting sooner will significantly reduce your litigation costs.

WeMediate will supply you with a checklist of all necessary documentation to be submitted before your first session. The number of sessions required varies depending on the complexity of the issues, such as asset division or parenting plans, but the goal is always to reach a mutually acceptable settlement.

Upon successful conclusion, a comprehensive settlement agreement will be drafted for both parties to sign. This document is then submitted to the court to open a case and obtain a case number and issue combined summons. Our process is streamlined for an uncontested divorce.

However, if one party fails to participate in good faith, the mediation will be concluded and a Certificate of Non-Participation will be issued. Our process is designed to be efficient and supportive, guiding you toward a cooperative resolution wherever possible.
